Delta-8: What You Need to Know


There’s been a lot of buzz about Delta-8 products in the past couple of months. Ultimately, a less psychoactive alternative to Delta-9 that is helping a lot of people overcome common ailments, addictions, and anxiety. So we’re going to break down and explain what you need to know if you’re looking to try any Delta-8 products. 

Here are our 5 things you need to know as a new user. 

What Is Delta-8?

First steps first, what are you putting into your body? 

According to the US Food and Drug administration “Delta-8 tetrahydrocannabinol, also known as delta-8 THC, is a psychoactive substance found in the Cannabis sativa plant, of which marijuana and hemp are two varieties. D8 THC is one of over 100 cannabinoids produced naturally by the cannabis plant but is not found in significant amounts in the cannabis plant. As a result, concentrated amounts of delta-8 THC are typically manufactured from hemp-derived cannabidiol (CBD).”

Meaning, when you take a Delta-8 substance you are taking a naturally derived THC product that has psychoactive effects. However, there are companies experimenting with ways to get more D 8/9 per plant so you should always be wary of anything that says synthetic Delta-8 because… it’s probably not Delta-8.

Is Delta-8 Legal?

Delta-8 is federally legal as long as the product is hemp-derived.

It is state legal for 29 states:


Alabama, Florida, Georgia, Hawaii, Illinois, Indiana, Kansas, Maine, Maryland, Massachusetts, Minnesota, Missouri,

New Hampshire, New Jersey, New Mexico, North Carolina, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, South Dakota, Tennessee, 

Texas, Virginia, West Virginia, Wisconsin, Wyoming, and in Washington D.C.


In our home state of Florida:

D8 THC is legal in Florida. But that could change if HB 679 passes. The proposed bill aims to create new regulations for hemp extract products and may even ban hemp-derived delta-8 THC entirely.

What Does Delta-8 Do?

Classified as a “psychoactive substance”, Delta-8 is similar to Delta-9 but reacts much differently in the body. The Green Dragon CBD describes it as “less intoxicating, but still a very strong “high” of mental euphoria, mental clarity and total body relaxation. It’s not weaker than it’s cousin Delta-9, but it’s different.

If you’re someone who is not comfortable with any high, then CBD is the choice for you. If you suffer from a medical condition or are looking for a little buzz, then this may be a great solution.”

What Is Delta-8 Used For?

Many people have reported that due to the “relaxing effects” it helps them sleep better and makes it easier for them to refrain from turning to alcohol or other harder recreational drugs. 


There’s a struggle with the FDA and Delta-8 because of the reported incidents with minors. As of 2021 there have been no reported deaths caused by the use of D8. There have been instances of adverse reactions (vomiting, nausea,  trouble standing…). However, from the months of December 2020 and July 2021, there were only 22 cases reported to the FDA. Of those 41% was due to unintentional exposure and 77% of those were minors.  

What we tell our customers is that we want you to enjoy the product but we also believe in being responsible users. Keep out of reach of children and pets, keep the product in a special place that someone won’t accidentally use it, don’t use it if you’re going to be leaving your safe place, and know your dosages. You can be held liable to any harm you may cause to yourself or others if not a responsible user. 

[Also side note, even with the correct dosage you will not pass a drug test if you’re taking Delta-8. It is a THC product and drug tests aren’t sophisticated enough to determine what kind of THC product it is.]
